Terms of Service

1. Overview

These Terms of Service ("Terms") govern your access to and use of the Keywords.app mobile applications (iOS and future Android), the website at https://keywords.app, and related services (collectively, the "Service") provided by In House Advantage LLC ("In House Advantage", "we", or "us").

By creating an account, installing the app, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility and Accounts

• You must be at least 18 years old and able to enter into a binding contract to use the Service.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You must promptly notify us if you believe your account has been compromised.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Modify, copy, prepare derivative works of, decompile, or reverse engineer any part of the Service.
• Circumvent or attempt to circumvent any security or technical measures.
• Use the Service to send spam, harassing content, or other abusive communications.
• Use the Service in a way that violates any third-party terms, including Google Ads policies and Google API terms.
• Interfere with or disrupt the Service, servers, or networks.

We may introduce new features or modify existing ones from time to time and may discontinue experimental or beta features.

4. Google Accounts and Third-Party Services

The Service may allow you to connect your Google account using Google OAuth to access your Google Ads account data.

• By connecting your Google account, you authorize us to use OAuth access and refresh tokens with scopes limited to your profile email and Google Ads, solely to access your Google Ads account data on your behalf via the Service.
• Access and refresh tokens are stored in encrypted form.
• You may disconnect your Google account at any time in the app, which will prevent further access to your Google Ads data.

You are responsible for complying with all applicable terms of any third-party services you connect, including Google Ads and Google APIs.

5. Data Storage and Processing

• Google Ads campaign and performance data retrieved via your Google account is processed and stored only on your device and is not stored or aggregated on our servers.
• When you log out of the app or uninstall it, Google Ads data stored in the app is removed from your device.
• Our servers store only limited account-level information needed to operate the Service, such as your email address, encrypted OAuth tokens, and subscription status.

6. Subscriptions, Payments, and Refunds

If you purchase a paid subscription or in-app product:

• Fees, billing intervals, and renewal terms are shown at the point of purchase (for example, in the Apple App Store or on our website).
• In-app purchases and subscriptions made within the iOS app are billed and processed by Apple via App Store In-App Purchase and are subject to Apple's terms and conditions.
• Subscriptions purchased through the Apple App Store or other marketplaces are managed by those platforms.
• Subscriptions purchased through our website are managed by us or our payment providers (such as Stripe).
• Unless otherwise stated, subscriptions renew automatically until cancelled.
• You can cancel:
  • App Store or marketplace subscriptions using the subscription management tools provided by that store; and
  • Website subscriptions either through your account settings inside the app or through the subscription management tools on our website.

Any refund requests for purchases made via the Apple App Store or other marketplaces are handled according to that store's policies and applicable law. Refund requests for website purchases are handled according to our policies and applicable law.

7. Intellectual Property

The Service, including all software, text, graphics, logos, and other materials, is owned by or licensed to In House Advantage and is protected by intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own internal purposes in accordance with these Terms. You may not reproduce, distribute, or create derivative works from the Service except as expressly permitted.

8. Beta Features and Service Changes

Keywords.app may offer experimental or beta features that may change, be limited, or be discontinued at any time.

We may modify or discontinue any part of the Service at any time, with or without notice, provided such changes comply with applicable law.

9. Disclaimers

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied.

To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant that the Service will be uninterrupted, error-free, secure, or that results or data will be accurate or reliable.

10. Limitation of Liability

To the maximum extent permitted by law:

• In House Advantage will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunities arising out of or related to your use of or inability to use the Service.
• Our total aggregate liability for any claim arising out of or relating to the Service or these Terms will not exceed the amount you paid (if any) for the Service during the 3-month period preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Termination

You may stop using the Service at any time and may request deletion of your account using any in-app tools we provide or by contacting us.

We may suspend or terminate your access to the Service at any time if you materially breach these Terms or applicable law, or if your use risks harm to us, other users, or third parties. Upon termination, your right to use the Service ceases immediately, and provisions that should survive (including ownership, disclaimers, limitations of liability, and governing law) will continue in effect.

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to conflict-of-law principles.

You agree to the exclusive jurisdiction of the state and federal courts located in Oregon to resolve any dispute arising out of or relating to these Terms or the Service.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date above and may provide additional notice where required by law.

Your continued use of the Service after the updated Terms become effective constitutes your acceptance of the changes.
